Mexico's New Data Protection Law
Mexico has joined the ranks of more than 50 countries that have enacted omnibus data privacy laws covering the private sector. The new Federal Law on the Protection of Personal Data Held by Private Parties (Ley federal de protección de datos personales en posesión de los particulares) (the “Law”) was published on July 5, 2010 and took effect on July 6. The law protects Personal Data and its use, allowing the right to privacy thanks to the Article 16 of the Political Constitution of the United States of Mexico.

Extract from the Law:
“Artículo 16.- El aviso de privacidad deberá contener, al menos, la siguiente información:
I. La identidad y domicilio del responsable que los recaba;
II. Las finalidades del tratamiento de datos;
III. Las opciones y medios que el responsable ofrezca a los titulares para limitar el uso o divulgación de los datos;
IV. Los medios para ejercer los derechos de acceso, rectificación, cancelación u oposición, de conformidad con lo dispuesto en esta Ley;
V. En su caso, las transferencias de datos que se efectúen, y
VI. El procedimiento y medio por el cual el responsable comunicará a los titulares de cambios al aviso de privacidad, de conformidad con lo previsto en esta Ley.
En el caso de datos personales sensibles, el aviso de privacidad deberá señalar expresamente que se trata de este tipo de datos.”

“Article 16. The privacy notice must contain at least the following information:
I. The identity and domicile of the data controller collecting the data;
II. The purposes of the data processing;
III. The options and means offered by the data controller to the data owners to limit the use or disclosure of data;
IV. The means for exercising rights of access, rectification, cancellation or objection, in accordance with the provisions of this Law;
V. Where appropriate, the data transfers to be made, and
VI. The procedure and means by which the data controller will notify the data owners of changes to the privacy notice, in accordance with the provisions of this Law.
